When someone commits a crime, they’re arrested and go to court, right? Not always. FOX 4 learned that if you lay low long enough after the crime you may never have to do the time.
Eunice Grant is a survivor. She not only beat cancer, but also lived through a wreck with a drunk driver in December of 2002. The driver, Jesus Lopez was charged with his 2nd DWI. Records show he had a blood alcohol level more than three times the legal limit when he hit Grant.
“He hit me head-on,” Grant told FOX 4. “I was delivered to Baylor (Hospital) in an ambulance.”
But Lopez won’t be punished for crashing in to Grant. He’s an “UNAP.” That’s slang around the Dallas County Courthouse for someone who is charged with a crime but hasn’t been apprehended. Lopez’s case was thrown out after five years in 2008. The prosecutor filed a motion to dismiss the case, which states - “the whereabouts of the defendant, who is unapprehended at this time, remains unknown.” Judge Jeff Rosenfield approved the motion, which also states - “it is desirable to clear the docket of the court of cases which cannot be prosecuted so that more current offenses may receive the attention of the court.” Rosenfield didn’t return our calls.
